Competition & Regulatory
Competition is a dynamic process. Stagnation inevitably means falling behind. Practically every sector of the economy is affected by the rules of play governing competition law.
The Competition & Regulatory practice group at Banning is made up of specialists with extensive experience, gained among others in Brussels and Amsterdam. The young and enthusiastic team provides high-quality legal services with a practical and effective approach. An approach that appeals to many (international) businesses, institutions and government organisations. We assist companies in cartel and abuse cases at the Authority for Consumers and Markets (ACM), in merger cases at the ACM and the Dutch Healthcare Authority (NZa) and in legal proceedings. We regularly advise on cooperation agreements, both between competitors (horizontal agreements) and within the supply chain (vertical agreements). We also advise various industry associations in their activities. We are (and have been) successfully involved in high-profile cartel, merger and state aid investigations in among others the food industry, the construction (materials) sector, the real estate sector, the postal and packages sector and the sports sector.
The advisory and litigation practice of this group covers all aspects of (European) competition law, including:
- Cartels and abuse of dominance;
- Merger control;
- State aid;
- Compliance matters and dawn raid investigations by authorities;
- Market & government matters (competing with the government);
- Follow-on cartel compensation claims;
- Procurement law.
Not only do we invest in keeping our legal knowledge up to date but we also constantly monitor the latest market developments. This knowledge enables us to offer pragmatic and targeted advice, and to contribute ideas for developments at strategic level. It prevents your business from slowing down Excellent examples are our tailor-made compliance programs.
